SAS SWEET PANTS, registered with the RCS of Nanterre under no. 800 418 857 whose registered office is located at 108 avenue Louis Roche 92230 GENNEVILLIERS, is organising a free "contest" with no obligation to purchase, entitled "SWEET PANTS X BACK TO THE FUTURE" and running from 14/10/2020 to 20/10/2020, as described in these Rules.
This promotional operation is free and without obligation to purchase, and is open to any natural person
wishing to participate in it, regardless of the city or country where he/she is located, with the exception
- Employees and representatives of the organiser, as well as members of their families (direct relatives, descendants and collateral) and their spouses;
- Employees and representatives of the partner companies of the operation as well as their families (ascendants, descendants, direct collateral relatives and spouses);
Minors may participate in the contest, provided that parental authority has been obtained beforehand and in writing and mentions the date.
In case of participation of a minor, the organiser will presume that the he/she has obtained this authorization, which may be requested at any time by the organiser.
The operation is announced by the organiser via various media (websites of the organiser, newsletters, social networks of the organiser, etc.)
Participation in the contest is deemed as full and unreserved acceptance of these Rules by the participant. Failure to comply with these rules will result in automatic cancellation of participation and forfeiture of any prizes.
The operation is accessible 24h/day throughout the contest period, from 14/10/2020 to
20/10/2020, associated with a countdown.
The countdown indicates the time available for participants to register on the various media mentioning the operation.
The ways of participating in this operation are as follows:
- Follow the Instagram page, "SWEETPANTS1982", of the organiser
- Tag at least two people under the post about the contest
- Complete the participation form
Participants will be able to access the following links from the various media supports of the organiser (website, social media, newsletter etc.): https://www.sweet-pants.com/back-to-the-future which will generate a landing page including the entry form.
To participate in the contest, each participant will have to properly and fully complete the dedicated form and follow the instructions requested.
The organiser reserves the right to carry out all necessary checks concerning the identity, telephone number, postal address, e-mail etc. of the participants.
Those who have not justified their full details and identity, or who have provided them incorrectly ordishonestly on the form, as well as those who refuse the collection, recording and use of nominative information concerning them and which is strictly necessary for participation and management of the operation, shall be excluded from participation in the contest.
In order to validate their registration, each participant must expressly accept the terms of these contest Rules, which will be accessible via a dedicated link during the registration process.
Each participant, upon registration, will also have the opportunity to accept offers from the organiser, including newsletters, which may be of interest to them.
It is further stated that:
- Each participant can register only once;
- Entries submitted cannot be modified;
- Entries may not be transferred to a third party.
When the countdown expires, the organiser organises the selection of the winners. It will select the
winners of the various prizes, in a random drawing from among all entries received.
The drawing will be done by and under the control of a Huissier of Justice (Bailiff).
The eligibility for the prize of the participants drawn will be verified. In the event that a winner violates these rules, another participant may then be selected at the discretion of the organiser.
Notification about winning entries will be given live on the Instagram page " sweetpants1982 " on 21/10/2020 starting at 5:00 PM.
Confirmation of the prize will be confirmed by email and/or SMS at the discretion of the organiser, within a maximum of 72:00 following announcement of the winners on Instagram.
If a winner does not come forward within 30 days of dispatch of the email and/or SMS confirming the win, the winner will be deemed to have forfeited the prize, and it shall remain the property of the organiser.
With the exception of the two preceding paragraphs, if the winner of the exceptional prize is not reachable and/or does not contact the organiser within 48h00 of announcement of his win on Instagram, another winner, called an “alternate winner,” who will have been previously nominated under the control of a bailiff, will be contacted by the organiser.
Solely due to acceptance of his/her prize, each winner authorizes the organiser to use his/her last name, first name and, if necessary, his/her image in any promotional event concerning the contest, without such use entitling the person to any right and/or compensation, other than the prize won.
The winner must comply with the rules. If it turns out that he/she does not meet the criteria of these Rules, the prize will not be awarded to this person.
The winners expressly authorise all checks concerning their identity, age, postal details or the proper form and accuracy of their participation.
As such, the organiser reserves the right to request a copy of a winner’s ID before the final award of the prize.
Any misrepresentation, indication of identity or false address shall result in immediate elimination of the participant and, where appropriate, the return of lots already sent.
In addition, the organiser will not be liable if the details do not match the winner's details or are incorrect. In this case, it is not up to the organiser to do further research to find a winner who is unavailable and who, as such, will not receive his lot or any compensation. The organiser shall not be held responsible for loss of the parcel or for theft from mailboxes.
It is stated that the prize draw by Huissier of Justice was set up to fight against automated robots and to ensure equal treatment for all participants.
However, the organiser reserves the right to change the drawing process at any time, at its sole discretion.
The contest includes the following prizes:
- The following exceptional prize: A pair of Nike Mag trainers known as "MARTY McFly" - size US 11/size Europe 45/ size UK 10, with a value in the second market estimated at 35,000 € (thirty-five thousand euros including VAT);
- 25 limited-edition sweatshirts resulting from the "SWEET PANTS X BACK TO THE FUTURE" collaboration, which will be personalized, of a unit retail value including VAT of between 90 and 100€ (between NINETY and ONE HUNDRED EUROS)
- 25 limited-edition T-shirts resulting from the collaboration "SWEET PANTS X BACK TO THE FUTURE", which will be personalized, of a unit retail value of 65 € (SIXTY-FIVE EUROS)
The prizes won are personal and cannot be awarded to another person.
In addition to the exceptional prize which is subject to special discount conditions described below, the
other prizes (25 sweatshirts and 25 t-shirts) will be awarded as follows.
If a sweatshirt or T-shirt is won, as defined in Article 5 of these Rules, the e-mail and/or SMS sent to the winner by the organiser mentioning the prize, shall specify the conditions for receipt of the prize.
In this case, each of the winners of a sweatshirt or T-shirt, as defined herein, shall have a code (valid for 1 month) mentioned in said e-mail and shall, via the website www.sweet-pants.com, log in and/or create an account and proceed with the purchase of prize to be customized with the code received, without any financial consideration.
The winner may customize his/her prize online, if applicable, by following the instructions given on the organiser's website.
It is specified that the login information (last name, first name, address, e-mail address, telephone etc.) on the www.sweet-pants.com website must be the same as that mentioned on the registration form for this contest.
The organiser shall not be held responsible for sending the prizes to an incorrect address due to the negligence of the winner. If the lots could not be delivered to their recipient for any reason, for any reason beyond the control of the organiser, they will be definitively retained by the organiser.
If the exceptional prize is won and accepted by the winner, the organiser will indicate to this person directly, by any appropriate means, the manner of transport of his/her prize.
If one of the winners is a minor, his or her prize will be delivered or sent to the adult who has parental authority for said minor.
Prizes are not interchangeable against any other object or against any monetary value and will not be eligible for partial or full reimbursement. Participants are advised that the sale or exchange of lots is strictly prohibited.
The value indicated for the prizes corresponds to the public price including VAT commonly practiced or estimated at the date of drafting of the Rules. It is provided as an indication and is subject to change.
The organiser cannot be held responsible for any incident/accident that may arise in the use of the prizes. All trademarks or product names mentioned in the contest are trademarks and signs belonging to their respective owners, other than those owned by the organiser.
The organiser reserves the right, notably in the event of force majeure, to shorten, extend, suspend,
modify or cancel the contest. Any appropriate means may be used to provide information about these

In the event of a technical incident preventing the participant from participating or altering the information sent by the participant, and for any reason, the organiser and its partners may not be held responsible for any harm which could result for the participants.
The responsibility of the organiser cannot be incurred because of a malfunction of the postal service or of the Internet.
The organiser shall not incur any liability because of the failure by the participant to comply with these rules.
It is strictly forbidden, by any process, to modify or attempt to modify the procedures of the operation, notably in order to modify the results.
Participation in this contest implies knowledge and acceptance of the characteristics and limitations of
the Internet, in particular as regards technical performance, response times to consult, query or transfer
information, risks of interruption and, in general, the risks inherent in any connection and transmission
over the Internet, the lack of protection of certain data against possible misappropriation, and the risk of
contamination by viruses circulating on the network. Accordingly, the organiser shall under no
circumstances be liable, without this list being exhaustive:
- for the transmission and/or reception of any data and/or information on the Internet;
- for any malfunction of the Internet which prevents the contest from running/functioning smoothly;
- for failure of any receiving equipment or communication lines
- for data transmission
- for loss of any paper or electronic mail and, in general, loss of any data;
- for routing issues
- for the operation of any software;
- for the consequences of any virus, computer bug, anomaly, technical failure;
- for any damage to a participant's computer;
- for any technical, hardware or software failure of any kind which prevented or limited the possibility of participating in the contest.
It is the responsibility of any participant to take all appropriate measures to protect his/her own data and/or software stored on his/her computer equipment from harm. The connection of any person via the links dedicated to the contest, and the participation of the participants in the contest are under their sole responsibility. The organiser may cancel all or part of the contest if it appears that fraud has occurred in any form, notably related to the information systems involved or concerning determination of the winners. In this case, it reserves the right not to award the prizes to the fraudsters and/or to prosecute the perpetrators of these fraudulent acts before the competent courts. However, it cannot incur any liability of any kind with regard to the participants due to the possible fraud committed. Fraud shall notably include the act, by a participant, of using one or more fictitious names or those borrowed from one or more third parties. As such, each participant must participate in the contest under his/her own unique name.
The contest is not managed or sponsored by the Instagram network, in turn operated by Facebook. Facebook cannot, therefore, be held liable for any dispute arising from the contest. If you have any questions, comments or complaints about the contest, participants should contact the organiser of the contest and not Instagram and/or Facebook. All submitted content is subject to moderation. The organiser has full discretion to accept, refuse or delete any content, including that already downloaded, without having to justify itself.
The organiser reserves the right, for any reason, to cancel, defer, suspend or extend the contest or to amend all or part of the terms and conditions of these Rules, in compliance with it. If, as a result of an event independent of its will, it were obliged to apply this right, its responsibility could not be engaged. The organiser reserves the right to exclude definitively from the various operations any person who, due to fraudulent behaviour, hinders smooth running of the contest. In addition, sponsorship of fictitious persons will lead to immediate elimination of the entry concerned. In addition, decompiling of the operation, the use of personal script or any other method to circumvent the intended purpose of the operation in these Rules shall also be considered as an attempt at fraud and shall lead to immediate and elimination of the participant without the possibility of recourse.
It is reminded that in order to participate in the contest, participants must necessarily provide certain
personal information (last name, first name, address, date of birth, e-mail address, telephone number
etc.), referred to as "personal data".
This data is collected by the organiser on the basis of the content of the participants.
In this case, it is processed in the context of implementation of the "contest" operation defined herein.
It may also be processed, if the participant has consented to it at the time of registration, so that the organiser can send special offers and newsletters relating to its brand and its products.
Finally, the organiser may be required to use the personal data of participants to prevent fraud or to guarantee the security of the network and information of the participants' computer systems.
This processing is based on the pursuit of legitimate interests of the organiser.
The organiser does not transfer any personal data to third parties, other than the service providers involved in this contest.
Personal data is stored on secure servers located in France.
In order to operate certain services and features, the organiser may need to have personal data transmitted and/or hosted on servers located throughout the world, provided that these servers have an adequate level of protection.
In any event, the organiser shall take appropriate measures to maintain the security of personal data during the transfer and receipt of such information.
This information is saved and backed up in a computer file.
In accordance with applicable rules, the data of participants shall be kept for a period which does not exceed the duration strictly necessary for fulfilment of the purposes, in this case processing for this operation (taking into account the participation, determination of the winners, awarding and delivery of the prizes, etc.).
This information is intended for the organiser and may be sent to its suppliers concerned by the operation for the purposes of the operation.
Data used for commercial prospecting purposes, and accepted by participants as such, may be retained for three years from the time of collection by the organiser or from the last contact of the data subject.
Data to establish proof of a right or contract, or to be kept in compliance with a legal obligation, may be subject to an interim archiving policy for a period not exceeding the duration necessary for the purposes for which it is retained, in accordance with provisions in effect.
The organiser shall take all appropriate technical and organisational measures to protect the transmitted
personal data against unauthorized or unlawful processing and against accidental destruction, loss or
- it stores this data on secure servers, and
- payment details are encrypted on the secure server.
In addition, each participant must, if applicable, protect their account password and not share it with anyone. It is requested to contact the organiser immediately in case of unauthorized or suspicious use of personal data in connection with the organiser's Internet materials, by contacting it at the contact details mentioned below.
Participants have the following rights regarding their personal data:
- Access and information: The right to obtain information on their personal data held by the organiser, and on the processing relating thereto; the right to access such data and to receive information concerning the purposes of the processing, the categories of personal data concerned, the recipients of the data, and the possible existence of automated and logical decision-making underlying the processing, as well as the length of data retention, other rights opened, the right to file a complaint with the Commission Nationale de l’Informatique et des Libertés;
- Withdrawal of consent: the right to withdraw consent at any time for the processing of their personal data when consent forms the legal basis for processing, being specified that the withdrawal of consent will not prejudice the lawfulness of the processing based on your initial consent;
- Claim: The right to file a claim with the Commission Nationale de l’Informatique et des Libertés;
- Rectification: The right to request rectification or modification of their data;
- Deletion: The right to request deletion of their data;
- Opposition: The right to oppose the processing of their personal data for reasons related to their particular situation and, in any event, to oppose the processing of their data for commercial prospecting purposes.

These rules are subject to French law. To be taken into account, any disputes relating to this contest or
the related operations must be put in writing and sent to the following address: contact@sweet-
pants.com, and no later than ninety (90) days after the deadline for participation in the contest as
indicated in these Rules.
In the event of persistent disagreement on application or interpretation of these Rules, and in the absence of amicable agreement, which shall in all cases be privileged, any dispute shall be submitted to the appropriate court, to which exclusive jurisdiction is granted.
